Paul Walker's Daughter Files Wrongful Death Suit Against Porsche
UPDATE: Porsche responded to the lawsuit in a statement to Variety, "As we have said before, we are very sad whenever anyone is hurt in a Porsche vehicle, but we believe the authorities' reports in this case clearly establish that this tragic crash resulted from reckless driving and excessive speed."
Nearly two years after Paul Walker's death, his daughter Meadow has filed a wrongful death lawsuit against Porsche.
According to the lawsuit obtained by TMZ, Walker was still alive after the crash, but was trapped in the car, his pelvis and ribs broken.
The docs allege he “breathed soot into his trachea while the Porsche Carrera GT burned."
While law enforcement claims driver Roger Rodas was speeding at 80 to 93 mph, the new suit says he was going 63 to 71 mph.
The papers also say Porsche knew the Carrera GT had "a history of instability and control issues,” but never installed the Porsche Stability Management System (PSM) in the cars, even though they were used in other models.
Meadow's lawyer, Jeff Milam, told TMZ, "The bottom line is that the Porsche Carrera GT is a dangerous car. It doesn't belong on the street. And we shouldn't be without Paul Walker or his friend, Roger Rodas.”
When Rodas' widow, Kristine Rodas, filed a similar suit against Porsche last year that accused the company of negligence and wrongful death, they responded by placing blame on Rodas.
"Roger Rodas's death, and all other injuries or damages claimed, were the result of Roger Rodas's own comparative fault,” Porsche's attorneys told the New York Daily News.
They added, Rodas "chose to conduct himself in a manner so as to expose himself and others to such perils, dangers and risks."
A judge dismissed most of Kristine's claims with the opportunity to amend and re-file in the future.
